Terms and conditions of sale
1 General
1.1 All business transactions with Kroumy© in the field of raw pet food (R.P.F.) shall be conducted exclusively in accordance with the following general terms and conditions of sale.
1.2 Kroumy© offers via its website www.kroumy.ch the sale and distribution/delivery of frozen raw food rations for dogs as well as food supplements and treats.
1.3 The purpose of these General Conditions is to define the rights and obligations of the parties in the context of the sale of Kroumy© products. They apply to all products offered on the website www.kroumy.ch.
1.4 All orders placed on the www.kroumy.ch website imply acceptance of these General Terms and Conditions, which the customer acknowledges having read, understood and accepted with full knowledge of the facts.
1.5 Kroumy© reserves the right to modify the present General and Specific Conditions of Sale at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations and orders previously accepted and confirmed with the customer.
1.6 Kroumy© products and services are offered only in French-speaking Switzerland. As of 01.01.2021, the areas covered are the canton of Geneva and the canton of Vaud up to the town of Nyon.
2 Prices and conditions
2.1 The sales prices of the services and products listed on the site are quoted in Swiss francs, all taxes included. Products ordered are invoiced at the prices in force when the order is registered.
2.2 The selling prices of services and products may be modified by Kroumy© at any time. The modification will then be indicated on our site.
2.3 Kroumy© reserves the right to apply or not exceptional discounts on its sales, according to its own conditions.
2.4 Our prices include VAT, transport (in the case of monthly orders), vacuum packaging, isothermal delivery carton, unless otherwise specified.
2.5 In the event of late payment, we shall be entitled to charge interest of 12% (annual basis) on the arrears without setting any additional period. In addition, the customer shall be obliged to reimburse us for all costs incurred by us in pursuing our claims.
2.6 The Customer is not entitled to reduce or meet its payment obligations by offsetting them against claims on Kroumy©.
3 Features – Product compliance
3.1 Kroumy© delivers standardized vacuum-packed and dry-frozen menus. The products offered by Kroumy© have been tested and validated by Kin’s Lebensmilltelinstitut laboratory in Germany. All the products offered by Kroumy© are validated at European level and therefore meet European standards and requirements.
3.2 For the standard menu delivery service, the products included in the rations comprise an assortment of three different menus (Poultry-Salmon, Poultry-Beef, and Beef) in quantities calculated according to the dog’s weight.
3.3 By validating an order, the customer is fully aware of and accepts the characteristics of the offer.
4 Availability
4.1 The offers presented by Kroumy© are announced on the Kroumy© website and are valid while stocks last.
4.2 In the event of unavailability of one or more products or services, the fulfillment of the order will not be possible in terms of packs/boxes. In this case Kroumy© will inform the customer but cannot be held responsible for any prejudice suffered by the customer, nor liable for any damages.
5 Controls
5.1 When the customer confirms his/her order by clicking on the “Confirm your payment” icon, he/she is considered to have accepted, with full knowledge of the facts, the content and conditions of the order in question, which include the present General Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the customer.
5.2 Kroumy© will confirm orders received by sending an email to the customer and a validation via Whatsapp (if accepted by the customer).
5.3 In addition, Kroumy© reserves the right to suspend or cancel any execution of an order and / or delivery, whatever its nature and level of execution, in case of non-payment or partial payment of any sum that would be due by the customer, in case of payment incident, or in case of fraud or attempted fraud relating to the use of the Website Kroumy©, including on the occasion of previous orders.
5.4 Also, in case of error in entering the e-mail address concerned, or non-receipt of the electronic message confirming the order, Kroumy© cannot be held responsible. In this case the sale will be considered final, except in cases of cancellation of the order by Kroumy ©, particularly for unavailability of products.
6 Payments
6.1 All orders are payable in Swiss francs.
6.2 Payment for purchases is made by bank card or invoice, to be paid no later than 15 days after the delivery date.
6.3 Kroumy© reserves the right to charge the customer for any additional costs incurred by the type of payment chosen by the customer.
6.4 The customer warrants to Kroumy© that he is fully authorized to use the payment card for payment of his order and that these means of payment legally give access to sufficient funds to cover all costs resulting from his order on the site www.kroumy.ch.
6.5 Kroumy© cannot be held responsible for any fraudulent use of the means of payment used.
6.6 Kroumy© reserves the right to suspend, cancel or maintain any order and / or delivery, whatever its nature and level of execution, in case of non-payment of any sum that would be due by the customer or in case of payment incident.
6.7 Any payment made on the www.kroumy.ch website will be processed using a secure data encryption procedure so that no information transmitted by the customer can be intercepted by third parties.
6.8 A copy of the invoice (of payment) is attached to each delivery, the customer receives a summary of his order and the status of his payment to the company Kroumy ©.
7 Completion dates and deadlines, acceptance
7.1 Working days are counted according to the Swiss calendar.
7.2 Except in extraordinary circumstances, deliveries are made every Tuesday and Thursday between 8:00 and 18:00.
7.3 The delivery dates indicated by us are not fixed dates. The actual delivery date may deviate by up to 2 working days from the delivery date indicated by us. In the event of deviations of up to a maximum of 2 working days, the customer is not entitled to assert claims of any kind against us.
7.4 Deliveries are made on a weekly, fortnightly or monthly basis, depending on the order. Monthly deliveries are free of charge within the Canton of Geneva.
7.5 Deliveries may be delayed if delivery is prevented through no fault of Kroumy. The Customer shall have no claim against the Seller/Reseller for delayed delivery.
7.6 The customer who is not present at the time of delivery has no claim against the seller/reseller if the package is missing, damaged or if the products are defrosted.
8 Reservation of title
8.1 Kroumy© retains full ownership of the products sold until full payment of the full price, including principal, fees, taxes and compulsory contributions.
9 Product liability
9.1 The products we supply are tested and approved by KIN’s Lebensmilltelinstitut laboratory in Germany.
9.2 Any liability on our part shall be excluded if the products are not handled in accordance with current recommendations concerning: the cold chain, storage, use of the products, recognized hygienic standards, as well as in the event of modifications to the products which were not carried out by us.
9.3 Continuing liability is excluded, irrespective of the legal nature of the claim asserted. Insofar as our liability is excluded or limited, this also applies to the personal liability of our staff, vicarious agents, managers and executive bodies.
10 Intellectual property
10.1 Kroumy©, its logo and graphics are trademarks protected by copyright. All elements reproduced on kroumy.ch (texts, comments, illustrations, images and trademarks are protected under intellectual property law). Any total or partial reproduction of the elements accessible on the kroumy.ch site is strictly forbidden.

12 Privacy policy
12.1 The information and data collected by Kroumy© during any order from the customer are necessary for the management of orders and commercial relations.
12.2 Customer information is kept strictly confidential. It will not be passed on to third-party companies for commercial or marketing purposes.
13 Legal capacity
13.1 Customers of the website declare that they are of legal age and fully capable of contracting.
14 Applicable law and jurisdiction / Place of jurisdiction
14.1 These general terms and conditions of sale are subject to Swiss law and Swiss standards.
14.2 Unless otherwise agreed, transactions (order confirmation), their execution and the rights arising therefrom are governed solely by Swiss law.
14.3 The place of jurisdiction is Geneva, Switzerland.
14.4 Should individual clauses of these general terms and conditions be wholly or partially ineffective, this shall not affect the validity of the remaining contract.
