Kroumy General Terms and Conditions of Sale (GTCS)
1. General
1.1 All commercial transactions with Kroumy in the field of raw pet food (B.A.R.F) shall be conducted exclusively in accordance with the following general terms and conditions of sale.
1.2 Kroumy offers via its website www.kroumy.ch the sale and distribution/delivery of food portions for dogs as well as dietary supplements and treats.
1.3 These General Terms and Conditions are intended to define the rights and obligations of the parties in the context of the sale of Kroumy products. They apply to all products offered on the website www.kroumy.ch.
1.4 Any order placed on the website www.kroumy.ch implies acceptance of these General Terms and Conditions, which the customer acknowledges having read, understood, and accepted with full knowledge.
1.5 Kroumy reserves the right to modify these General and Specific Terms and Conditions of Sale at any time without prior notice. Such modifications will not apply to bookings and orders previously accepted and confirmed with the customer.
1.6 Kroumy’s products and services are available throughout Switzerland.
2. Prices and Terms
2.1 The sale prices of services and products shown on the site are indicated in Swiss francs, including all taxes. Ordered products are billed at the prices in effect at the time the order is placed.
2.2 Kroumy may modify the sale prices of services and products at any time. The change will be reflected on our website.
2.3 Kroumy reserves the right to apply or not apply special discounts at its sole discretion.
2.4 Our prices include VAT, transport (for monthly orders), vacuum packaging, and insulated delivery boxes unless otherwise stated.
2.5 In case of late payment, we reserve the right to charge CHF 15 (for second reminders) on arrears without setting an additional deadline. Additionally, the customer will be required to reimburse all costs incurred by us as a result of pursuing our claims.
2.6 The customer is not authorized to reduce or settle their payment obligations by offsetting them against claims against Kroumy.
3. Product Features – Compliance
3.1 Kroumy supplies standardized menus, vacuum-packed and freeze-dried, raw and cooked, as well as freeze-dried food. All products offered by Kroumy are EU-compliant and meet European standards and requirements.
3.2 For the standard menu delivery service, the rations include a selection of three different menus (Poultry-Salmon, Poultry-Beef, and Beef) in quantities calculated according to the dog's weight range.
3.3 By confirming the order, the customer fully acknowledges and accepts the characteristics of the offer.
4. Availability
4.1 The offers presented by Kroumy are published on the website and are valid while supplies last.
4.2 If one or more products or services are unavailable, the order cannot be fulfilled in the form of packs/boxes. Kroumy will inform the customer but cannot be held liable for any resulting damages or compensate the customer.
5. Orders
5.1 When the customer confirms their order by clicking on the "Confirm your payment" button, they are deemed to have knowingly accepted the content and terms of the order, including these General Terms and Conditions, the prices, features, quantities, and delivery times of the ordered products.
5.2 Kroumy will confirm received orders by sending an email to the customer.
5.3 Kroumy also reserves the right to suspend or cancel any order or delivery, regardless of its status, in the case of non-payment, partial payment, a payment incident, or suspected fraud on the Kroumy website, including related to past orders.
5.4 In case of incorrect email address entry or non-receipt of the confirmation email, Kroumy cannot be held liable. The sale will be considered final unless canceled by Kroumy due to product unavailability.
6. Payments
6.1 All orders must be paid in Swiss francs.
6.2 Payments may be made by credit card or invoice, to be paid no later than 20 days after the delivery date.
6.3 Kroumy reserves the right to charge the customer for any additional fees incurred due to the selected payment method.
6.4 The customer guarantees Kroumy that they are fully authorized to use the chosen payment method and that sufficient funds are available to cover the order.
6.5 Kroumy shall not be held liable for any fraudulent use of the payment method.
6.6 Kroumy reserves the right to suspend, cancel, or continue any order and/or delivery in the case of non-payment or payment issues.
6.7 All payments made on www.kroumy.ch are processed through secure encrypted channels to ensure that no customer information can be intercepted by third parties.
6.8 A copy of the invoice is included with each delivery, allowing the customer to review their order summary and payment status with Kroumy.
8. Deliveries by Kroumy Partners
8.1 For areas outside Kroumy’s delivery zone, parcels are shipped via our partner (Swiss Post).
8.2 Each parcel is specially packaged to ensure 24-hour delivery without breaking the cold chain.
8.3 In case of delivery error by our partner, Kroumy will resend the exact same order at no additional cost until the full order is delivered.
9. Product Liability
9.1 Kroumy assumes no responsibility if products are not handled according to proper cold chain practices, storage, usage, hygienic standards, or if products are modified by anyone other than Kroumy.
9.2 Ongoing liability is excluded, regardless of the legal basis. If our liability is excluded or limited, this also applies to personal liability of staff, agents, and executive bodies.
10. Intellectual Property
10.1 Kroumy, its logo, and graphics are protected trademarks. All content on www.kroumy.ch (text, comments, illustrations, images, trademarks) is protected by intellectual property law. Any total or partial reproduction is strictly prohibited.
11. Customer Service

12. Privacy
12.1 Information and data collected by Kroumy during customer orders are required for order management and business relations.
12.2 Customer information is strictly confidential and will not be shared with third parties for commercial or marketing purposes.
13. Legal Capacity
13.1 Customers declare that they are of legal age and fully capable of entering into binding agreements.
14. Applicable Law and Jurisdiction
14.1 These General Terms and Conditions are governed by Swiss law and standards.
14.2 Transactions (order confirmations), their execution, and resulting rights are governed exclusively by Swiss law unless otherwise agreed.
14.3 Jurisdiction is Geneva, Switzerland.
14.4 If any individual clause is found to be partially or wholly ineffective, the validity of the remaining contract remains unaffected.
